It is, from what I understand of the situation, more like someone's kid drowned in a pool and they want to keep you from building a bird-bath.
In most instances that bird-bath is -
a) Out of their sight and they only know about it because the local busy body keeps making a fuss about how offensive.
b) your own kid drowned at the same time and in part that bird bath is in the memory of all the kids who died and is open to all the community to come and see birds bathing as a way of reminding people of the importance of pool safety...
