Even if you were still married to them, what if you wanted psychological therapy to gain the strength to divorce them. In this instance, I could see how that'd actually be a pretty good investment for the company. Pay a portion of the person's therapy fees, and then sign them on as a fully insured client (perhaps at an increased rate).
In anycase, you could probably argue all sides all day and not get anywhere.
