Except in cases where the federal government is granted power the states often have more flexibility than the federal government has. A lot of the restrictions placed on the federal government don't always apply to state governments. It was just recently ruled that local governments have limits to restricting gun ownership rights but even then the state still have much more power to restrict gun ownership than the feds do.
