Only the validity of the public vote on the issue. It was legit and SCOTUS will recognize it as such.


Strauss v. Horton dealt with the validity of the public vote on the issue. It was done by the State Supreme Court after prop 8 and the decision was 6 to 1.

Perry v. Schwarzenegger now called Perry v. Brown is about whether Prop 8 violates the 14th amendment of the US Constitution. If the case violates the 14th amendment (the equal protection under the law amendment added after the civil war), then the supreme court will gladly overturn the will of the people. Constitution is supreme in the US, it has something called the frickin Supremacy Clause in it
