To be president of the harvard law review does not mean you were appointed by the staff, instead you were chosen by your peers. At the time of Obama being in the Harvard Law Review there were a total of 80 editors, to become president you have to receive a majority of these 80 editors votes.
And I'm supposing that there was more then one qualified candidate when it came time to choose? And if President Obama and another equally qualified individual (who wasn't part of the same race/gender demographic) were up for it...
Let's remember that Affirmitive Action doesn't necessarily have to be institutionalized to be effective.
