Seriously though, the ACLU needs to put a sock in it. No one should be made to facilitate something he is opposed to because of his beliefs, no matter how ridiculous.
I don't know the letter of the law, but it's obvious that the law is that 1)Discrimination in government based on race is not allowed and 2) Interracial marriages are perfectly legal.
If the judge is saying, "No, I will not grant your marriage license specifically because it is an interracial marriage," it's the same thing as the US Government going "You cannot get married because this is an interracial marriage."
The judge is a representative of the government. He must obey its laws.
Now, if it was a minister of some church, that would not be a legal issue.
