That depends on the animal and the amount of abuse. I would never send someone to jail for something he does to animals, but of course severe cases should get punished one way or another. Don't get me wrong, I love most animals, but as I said, humans come first, as long as they act reasonably.
What about a person who repeatedly poisons his neighbor's dogs by putting antifreeze in their outdoor water bowls - causing the neighbor to spend over $20,000 in veterinary fees to save them?
This is not a hypothetical situation, and it's one where I really, really think that jail time would be appropriate. As well as compensation for the vet bills, obviously.
I guess we're a bit more jail-happy here anyway, but I'd definitely say that torturing animals rates as a worse crime than, say, getting caught with a few ounces of marijuana.
