You can get away with a fair amount of subversive activity in this country and still be protected because of free speech laws. With a law like this they can claim they are not impeding your free speech they simply requiring you to register just like we require protesters in public areas to register. This gives them an avenue to go after groups they consider subversive that may have been otherwise protected, notice it does so directly or indirectly. No idea if it will hold up in court but I think it can still be effective even if it is later overturned. Once your group has been labeled as trying to subvert the US government it will never shake that label.
