The book doesn't reveal it for sure, but Brandon has pointed back people who asked those questions to Semirhage's comment about betrayal by the Great Lord.
I went looking and found this:
Matt: There was some confusion about Rand and the Dark One’s permission, so for clarification’s sake, did Rand have the Dark One’s permission to use the True Power?
Brandon: I have not answered that. If anyone says that I have, I have not. What I have said specifically is, this is recording: generally one must have the Dark One’s permission to use the True Power. Semirhage believed that the Dark One had betrayed her by letting Rand use it. It is good that you have asked this so I can make sure on the record that is the answer I have given.
This does not really confirm or deny it in any way. He says that you need the DO's permission "generally", implying that there is a way to use it without his permission. He also says that Semirhage believed she had been betrayed, but does not say if she is actually correct in that belief. Semi does not know about the balefire link which makes her view potentially inaccurate.
It's pretty much a given that the DO made the TP (that is, himself, since the True Power is Shai'tan. LTT told Rand, and Brandon confirmed it in Q&A) available to Rand.
The TP is the DO, but BS has not 100% confirmed that the DO gave it to Rand. The possibility that Rand took it from the DO without permission via Moridin is quite possible.
