Many indications are that Ishamael created them and kept up with history enough to know that the White Tower used the Oath Rod to control their Aes Sedai after a certain point.
I think Ishamael created the Dark Oaths, and being a philosopher (i.e. very lacking in common sense and with a very limited understanding of human nature), he messed up and made poetic sounding Oaths that were not foolproof.
