What they came to the Black Tower (uninvited by any legitimate authority, BTW) to do is illegal by their own rules of the White Tower. Illegally or unlawfully killing people is murder. Screw them.
Admittedly Tower Law does state that the men must be tried. Regardless, their captivity is just as unlawful, so I don't really see the logic you're employing. Breaking two laws doesn't make something lawful (just something awful).
Since when is self-defense unlawful? Someone attacks you in an illegal manner, and your only legal options are kill them or set them free to try again? Releasing the Aes Sedai would be criminally incompetant. And what law is it violating to take Aes Sedai captive in self-defense?
