It's a dangerous precedent to set, because it would almost certainly lead to revenge allegations of a partisan nature. If Obama does it, he is guaranteeing that the next Republican President will find a reason to indict him.
Just like every dictatorship on the planet, when the current regime falls, the new one prosecutes the previous one for reasons, real or fabricated. It would an absolute disaster if it began here. And yes you're right, make no mistake, the next Republican administration would find justifications to settle the score. Which sets us up for a party in power to do everything it can to remain in power so as not to be prosecuted. Republican Rome, anyone?
