Playing a trick like that ought to make a conviction very hard, or at least give grounds for a long line of appeals. I don't understand why they didn't just go round to their houses and arrest them there. They obviously knew where they lived or they couldn't have sent letters.


I wasn't particularly interested in its legality, of course, just the humor of it, but I think it's a valid arrest. Cops are allowed to lie to people, contrary to the popular rumor otherwise which I think they encourage. They weren't trying to convince anyone to commit a crime they otherwise wouldn't have, so it's not entrapment. It didn't involve any sort of illegal search, they just lied to people that they'd give them something. One could kinda maybe claim fraud but under common law that's gonna run right into #8 and 9, plaintiff's right to rely upon it [the claim]; and consequent damages suffered by plaintiff. I don't think one can establish they had a right to rely on a free ticket and could claim any damages, since being arrested and fined for having a warrant out on you is not legitimate damage.
