This decision will not appear before Nov 2012 there is little chance they are going to take up the issue in this years docket. Next year docket will begin on the first monday of October (Red Mass on the day before, on Sunday). Edit: Even if they hear the case prior to the election in October there is little chance the decision will be done in 36 days.
And this is assuming that the people who lost the case doesn't ask the for a 11 judge panel (instead of the 3 judge panel that ruled 2 to 1) in the next 2 weeks. The supreme court (which has 90 days to take up the issue) most likely won't want to grant cert unless the larger group of the 9th circuit takes up the issue.
