we are looking at invalidating pretty much one quarter to half of the federal government's decisions since madison was president if recess appointments are not valid.


A President making appointments when the Senate is legally in recess is one thing, but the Senate remained in session specifically to prevent Obama making those appointments, but he did it anyways. It is not up to the President to determine when the Senate is in session and when they are not.

Personally I think the majority of the Senate needs to be thrown out on their ear for not doing their job (not even trying to pass a budget for the last 5 years is an excellent example), but Presidential overreach can not be allowed.
