Selling loose cigarettes is only illegal if the pack lacks a tax stamp: Any video of THAT? Otherwise, selling loose cigarettes from taxed packs is common and legal; I have known many people who never let people bum cigarettes, because the cost too much, but have also known many happy to sell someone a cigarette for a quarter to recoup (or even exceed) that cost. Either way, stopping it is not worth a mans LIFE.
As noted in moondogs thread on Samuel DuBose, a scary part of both sides injecting their parstisan politics into police brutality is that, despite disagreeing on all else, left and right share a unanimous consensus that
1) Victims of unjust police assaults are innocent of ALL wrongdoing, and 2) All police assaults are justified if the victim is guilty of ANY wrongdoing.
It need not even be a CRIME: If an unarmed person "contributed to" police killing them they have no one but themselves to blame: Next time do not mouth off! That is how police "uphold the law" in dictatorships, not free democracies. The Saudis cut off theives' hands, but even THEY do not condone SUMMARY EXECUTION. Is this the United States of America, or a Judge Dredd comic?
If "performing a Code Red" on someone kills them, the killer is legally liable, whether or not they intended to kill, and whether or not the dead person committed any crime: Lethal force is only justified to resist lethal force, not defend replaceable property, prevent a "perp" escaping the wrathful arm of the law, or strongarm someone to arrest them for an alleged crime next to impossible to prove (even if Garner WERE selling illegal cigarettes, all he had to do was stick all the "loosies" in a Ziploc bag and leave the unstamped packs at home, or in a dumpster.)
