If they push it it will go to the supreme court and be overturned. The constitution clearly gives congress the authority to regulate the military.
Could end up there eventually but in the mean time the military will continue to get sued by those discharged in the 9th Circuit. It probably doesn't hurt them if they can tie the cases up but then again they risk losing the cases for sure (or settling) if they tie the cases up and then the military/Congress overturn the policy anyway. Maybe their best bet is to negotiate an honorable discharge and certain benefits or something if the soldier/officer agrees to resign?
