Other passengers had already called 911, helped Penny restrain Neely, and testified they were in fear of their lives.

With two other people helping him, once the initial struggle was over and they were holding him down, how hard could it be to keep restraining the guy without cutting off his air supply? Again, not saying it's murder and of course I wasn't there, but it does seem like he should've known better - after the highly publicized choking deaths in police custody in recent years, if you still keep resorting to such techniques, you know the risks.
