Why would they fear being killed by the courts when it is so much more likely another gangbanger will kill them? If fear of death was going to stop them then the rate they are killing each other would already have done it.

Ask yourself this. What would be the result of killing ant soldiers you captured in war? They wouldn’t stop fighting you they would just stop surrendering. If you start executing every gang member who commits murder you remove their incentive to surrender and you will never bring one in with a shoot out. You would loss valuable intel and a lot of police officers not to mention the innocent bystanders and inevitable hostages.
