The UN would never have given him the death penalty and the people of Iraq would have settled for nothing less. Holding it in th US was PR nightmare and he would probably be still waiting trial along with KSM. Besides the people of Iraq had a greater claim to him then we did. The trial was far from perfect but it really wasn't that bad either. It was public and he was allowed to present a defense. He never stood much of chance true but his overwhelming guilt played a factor in that.

I personally don't have a problem with either result but I fail to see just killing the guy as a more moral action. Neater true but from what I can make out there was very little encouragement to take him alive (I strongly suspect the encouragement went the other way) and don't think it is morally cleaner to just kill people to avoid a messy trial and execution.
