Crimes against certain groups tend to be sentenced more leniently than usual. One can expect more variance in this the more locally and less visibly the case is prosecuted. That is why federal prosecution is a good thing for hate crimes. On the other hand, I'm rather dubious about how hate-crimes legislation mandates sentences. The legislation should increase the minimum sentence for hate crimes, but sentencing should still be capped at the normal maximum sentence.
