Second, the timing of the statement is the problem. Everyone knew he was gay. It was no shock to anyone. But deflecting from the possible sexual assault to come out is the problem. Timing is the issue. Why come out then and there? To deflect from the issue at hand. So he is using the quite difficult process of coming out (I support peoples' right to come out when and there they choose to do so) to further his own ends. Its positively Underwoodian.
Though the even bigger problem, in my eyes, is that Spacey has not actually said he is guilty and so we must presume innocence until proven guilty. In the modern world where the accused word trumps the accuser, it seems in the court of public opinion he is already guilty.
Still, this is Hollywood. He will eventually come back from this. And House of Cards was already going to have its last season as season six.
