How anyone can, with a straight face, claim that conservative judges aren't activists after Citizens United is beyond me. And similarly, how can anyone look at Heller and claim that somehow conservative judges are more likely to respect major precedent?
The basic fact is, "judicial activism" is a window-dressing term used by both sides when the justices make a decision they don't like. It sounds like the opposition to that decision is based on principle, then, and not politics. But the numbers don't lie. Activism is employed by judges of all political leanings.
