In the previous incident, the vehicle was not being driven by a protester, but reportedly by an illegal with a history of arrest and conviction for sexual assault of a child.
It's not in conflict with any of your points, I don't think, but facts matter.

It does raise a legitimate question. Was he psych evaluated before being returned to full active duty? No doubt this will be part of the investigation.
