Scum have a tendency to be silent, but rarely absent. If it goes down to a kill, they'll generally act up. So in this case, I suspect that Amys is probably town. It doesn't especially matter, because keeping an inactive player hinders the town by raising the number of votes needed to lynch, and we're unlikely to bring up a real scum suspect before Day's end, but in general, I prefer genuinely trying to catch a scum before Night, which is when they get the opportunity to strike back. If we expend our lynch, we essentially "skip our turn" in the game.
