Batman is alongside but OUTside the law; he is a vigilante, and for good reason. That is not to say he is a homicidal psychopath, but when lethal force is justified and necessary Batman will not hesitate to apply it without regret. As opposed to Superman who, of course, will take "superhuman" pains to avoid it and go catatonic if he actually DOES kill someone (well, humans anyway.)
