Unless Canadian family courts are very different from American ones you are not in a pleasant ride. Custody battles are ugly and all the cards are stacked against the dad. Not saying you can't win but if this actually goes to court expect her to say more then she does 90% of the child care. The goal will become to prove the other is unfit to have custody. I would push hard for mediation if I were you and get her to agree to something reasonable and if you don't have a lawyer get one now and be prepared to spend a gross amount of money in fight you will probably lose. Just having a lawyer will put you in a better position negotiate. Unless she has access to a large amount of money the cost of a custody battle may convince her to be fairer to you.

Sorry to sound so grim but it is a grim situation.


She has no amount of money (I'm supporting her) but unfortunately that means for her the lawyer is free while mine will cost me.

Legal Aid lawyers often aren't very good though.

Our court systems are a bit more modern in that parental rights seem a bit more balanced up here than down there. Not sure why - maybe because having fewer people lets the overall legal system evolve more quickly (not as many cases before the courts).

The legal advice I have from my EAP is to stay reasonable and work through mediation, only turning to a court battle as a last resort. Apparently that's how the courts here like to do things if they can. If I stay reasonable in mediation (and she doesn't) that's also evidence against her in court.

She can claim 90% until she turns blue but reality doesn't match that and there are boatloads of witnesses to the reality. It'll fly like a lead duck.

So, we'll see. I'd much rather this not get unpleasant, but I'm a fighter and if it does, it does. I just don't want it wrecking Melissa's life.
