As I've never been in the situation, I can't speak from experience. But....

Should I ever be arrested, and my rights are read, and I acknowledge understanding of said rights....well, I should either state "I'm not telling you shit" and then shut-up for good, or else I should expect that what I say can and may be used against me. You know, exactly how the cops say it can/will.

If I just sat there like a bump on the log for however many hours, never acknowledging that I will say nothing and I want a lawyer, and then I suddenly speak up with information that can be used against me.....well, f*** me! I'd be an idiot and deserve it.

Bottom line: shut up and lawyer up. Very simple.

Sotomayor's reasoning of making illogical figure 8's out of a logical straight line is the most concerning issue in the entire article for me. By her standards, it's too complicated for a suspect to state "I'm not saying anything" because that would make them think that by doing so they now have to cooperate with the police? WTF? Even if you don't accept your rights and completely ignore Miranda you still don't have to say jack to the police. They cannot force words out of your mouth.
I would slave, to pave the way, to sink your ship of fools.
