One's rights under Miranda haven't been lessened. This suit was an attempt to expand them, not maintain them. Everyone here knows I'm a huge proponent of personal liberties, but I don't see this ruling as some big new evil. Your right to remain silent hasn't changed. You still have the right to remain silent. Even if you don't "invoke" your right, if you don't say anything, there's nothing for the police there. Just as Miranda states, things you actually say can be used against you until you request an attorney.
Actually, if you think about it, Miranda was expanded with this ruling. Before, until you requested an attorney, they could question you no matter what you said or didn't say. Now to make them shut up, even without asking for a lawyer, all you have to say is that you're invoking your rights not to say anything. So now, anything you do say after that, can't be used against you.
