It MUST exist though; the treaty explicitly binds the US and the now non-existent city state of Tripoli in PERPETUAL (i.e. eternal) friendship and peace, and since the Supremacy Clause makes treaties absolute, we remain in perpetual friendship with a non-entity. Incidentally, as I noted above, the greatest testament to our perpetual friendship and peace with the city that became the capital of Libya is that we're STILL at peace with them after we sent a squadron of F-15s to kill their leader in the late '80s. Just as every iota of every treaty ever ratified, including any exposition by its drafters and the pompous honorifics once bestowed on dignitaries, is United States federal law. If we sign a treaty with Elizabeth II citing her title as "Defender of the Faith" then US law recognizes Elizabeth II as the Defender of the Christian Faith, and to heck with the inferior First Amendments Non-Establishment Clause. When the various Treaties of Paris ended various of our wars, the fact they were signed in Paris is not mere historical fact: It is United States LAW, because it's in the ratified treaty that the Supremacy Clause established as absolute.
Or, possibly, just MAYBE, there's a more logical, rational and practical option that's being deliberately ignored.
