Law and Justice isn't in the government anymore, nor do they have the president now. Tusk and his party aren't homophobic, so they have no reason to go anger the EU on an issue like this.
I'd managed to forget the bothers aren't in power there anymore. Even so, Poland is quite a socially conserviative country still but yes, less likely to support an extreme position.
