Issue 1: should the actual act be illegal and lead to criminal penalties such as jail time or fines?

Issue 2: should relatives have a civil claim for action against the necrophile?

The first issue, to my mind, must be answered in the negative. The second issue, on the other hand, is one that could be answered in the positive. The real issue is whether the relatives find out and how they find out. Intentional infliction of emotional distress is a valid claim.
