Issue 2: should relatives have a civil claim for action against the necrophile?

The first issue, to my mind, must be answered in the negative. The second issue, on the other hand, is one that could be answered in the positive. The real issue is whether the relatives find out and how they find out. Intentional infliction of emotional distress is a valid claim.

That may be distinct from the act, but it's a direct result of it. If I start a fight in a bar and break someones arm he's got grounds for a civil suit, but it's also criminal assault, yes?
