Obviously laws exist that say "If you are doing X, and fail to desist on being so requested by a police officer in uniform, you commit an offence". For example, where I live drinking in the street is legal, but you have to stop if the police ask you to. That of course is fine, and it may well be that all OWS arrests are for offences of this sort. But if a police officer happens to hate (say) baseball caps, they can't go up to you in the street and tell you to take off your baseball cap, then arrest you for not doing so, and then charge you with resisting arrest when you try to escape from your unlawful arrest. (If there is some specific law against baseball caps in NYC, replace them in my example with something equally innocuous and random.)
