There has to be evidence that the attacker has to be motivated due to race, religion, sexual orientation etc. Just because the victim is gay doesn't mean squat unless the attacker attacks the victim due to the fact and the prosecutor has evidence to bring a hate crime charge.
Regardless I don't see the difference you are trying to make. If a black women is targeted by a drunk man for she is black, it shouldn't matter in my mind if the man is alone, or he only attacks people when drunk.
The drunk part doesn't really matter to me. To me there is a difference if some guy decides he wants to go gay bashing because he hates gay people, and if a KKK group goes out and decides they want to beat the hell out of some black people. They are both ugly crimes, and should be treated as such, but to me one should be treated as a regular crime, and one should be treated as something more. I don't know if that really makes sense to you, but it's simply the way I view it. Crimes that actually have a victim aren't usually done out of love...they are usually done out of anger and some form of hatred for the person they are commiting the crime against (I'm talking violent crimes here...property crime is a different monster completely). I would view ideal hate crime legislation to target groups that spread hate, and commit crimes against the groups that they are spreading hate against, while leaving the individual idiots out of the equation.
