I'm kind of hoping not. They should contact him with a legal order for full back child support, and offer to "let him off the hook" if he signs away his rights. Bribe him. It will be a much better situation for the child and for your brother.
That's a good way to handle it.
They could terminate his parental rights for non payment. Or get back child support. If his rights are terminated, your brother can adopt at any time.
