You are wrong on the issue. Roland00 Send a noteboard - 28/06/2018 05:06:29 AM

One can lose their kids for neglect or endangerment. In fact, if an American citizen tried to cross a desert with their minors, they likely would lose their kids. Getting them involved with criminals like smugglers and traffickers could (and often does!) also have that result.

The court has to show that the parent is unfit to sever parental rights. Aka they are endangering the child and so on. The problem is the Trump Administration was separating the children from their parents merely after accusing the parents of a misdemeanor and not even waiting for a hearing showing that the parents are unfit in anyway.

The Adoption and Safe Family Acts says 15 of the most recent 22 months should occur before states should attempt Termination of Parental Rights when the child has merely been in Foster Care (if the parent is a harm to their child is another matter, but you can't just do a blanket saying you are hear illegally and I can thus take your kids from you.)

Since the No Tolerance Trump Decision happened April 6th we are nowhere near that 15 months. The parents even in prison / detention waiting for hearings have parental rights, and that includes knowing where there children are being sent even if the children are being sent someplace for they are not supposed to be in a detention area.

What Trump is doing is flat out against the law. (This is why recently a district court said that Trump has to reunite the children within 30 days, and priority to children under 5 in 14 days.) What Trump is doing could be done in a legal way but he is skipping steps, he is skipping due process. And even after he signed the executive order he is delaying the reuniting of the children with their parents hoping the parents will self deport by signing a waver of their previous request for asylum retracting their previous request.

You are painting with a broad brush of saying all people who are outraged are hypocrites. Many of the people may just be outraged due to it being Trump. Other people would be outraged for other reasons including just learning what is happening. People like me are FURIOUS for this is a complete attack on the rule of law. If you want to separate parents from their children and terminate parental rights there is a process so do it, and do it legally. We have a legal system to reduce the outcomes of bad outcomes caused by rushed thinking.

(I will respond to the other post between me and you later, probably tommorrow.)
