If you were sunbathing nude in your driveway your neighbors could stand there smiling and take pictures to post on the internet and you could nothing about it. If instead you were in your backyard behind a privacy fence and he climbed in a tree to take pictures he would have invaded your privacy.

It isn't a question of property rights it is a question of expectation of privacy.
