and more that people should expect privacy despite the lack of fence. If you make the distinction that someone with a fence can't have their home invaded by the police, but if they magically didn't have a fence it would be okay, how is that right? A driveway is RIGHT BY a person's home and sleeping quarters. Would the courts also rule against someone who thought someone was trying to rob the and assaulted the individual...only to find out it was an officer?

A driveway is private or it is not. Even if you have to cross a fence to get TO the driveway, there is not typically a fence between the house and the drive. Once you're to the drive, the "privacy" is typically the same.
