I think the trauma to the familys could (and probably should) be considered criminal as well. Joel Send a noteboard - 12/01/2011 09:07:57 PM
Issue 1: should the actual act be illegal and lead to criminal penalties such as jail time or fines?

Issue 2: should relatives have a civil claim for action against the necrophile?

The first issue, to my mind, must be answered in the negative. The second issue, on the other hand, is one that could be answered in the positive. The real issue is whether the relatives find out and how they find out. Intentional infliction of emotional distress is a valid claim.

That may be distinct from the act, but it's a direct result of it. If I start a fight in a bar and break someones arm he's got grounds for a civil suit, but it's also criminal assault, yes?

No and yes, because of the issue of consent. - 12/01/2011 07:11:31 PM 346 Views
Only people can provide consent. Corpses are not people, just rotting meat. *NM* - 12/01/2011 08:40:02 PM 151 Views
I suppose that's fair, but I wouldn't try selling it to the family. - 12/01/2011 08:56:30 PM 367 Views
