Unless she slept through the whole thing, she was in a position to consent. If someone wakes up to heavy petting a few hours after consensual sex and does not say, "stop," consent is heavily implied because previously given and very easily withdrawn.

This idea of your's that consent is implied is utter nonsense - if you go to sleep is is pretty obvious that it is over.
If someone performed them on me and I never told them to stop I would not blame them for my "refused refusal." We are not talking about a random sex act out of the blue, but someone who (supposedly) already agreed to sex withdrawing consent. Once consent is formally given expecting it be formally withdrawn is reasonable.
