Is how much private property it would need to traverse. I believe 66% of the Texas border with Mexico is either state or private property. Maybe the state wouldn't fight the eminent domain claims, or not. Maybe some landowners wouldn't mind either. But I can't imagine all would be thrilled with a thirty foot tall wall bisecting their land.

I'm pretty sure a bunch of the wall can be stopped with lawsuits, and attempts to do so would definitely be made. But I think it would be tough to contest an eminent domain claim at the border itself.
