"Refusing"? How about not being in a position to consent?
only noted that waking up to renewed sex is hardly unprecedented.
And neither are any number of other sex acts but I would imagine you would not be so blasé about someone performing them on you because you didn't have the chance to refuse before they started.
Unless he got the woman's consent in advance to have sex with her while she was asleep if he woke up first and was feeling randy then it is rape. You do not just start performing sex acts on someone and assume it is fine because they haven't said no yet.
