Though some of my reaction still stands regardless of what is being discussed - I do think it is completely unreasonable to assume that because someone wanted to have sex and did so at, say, 11pm then they are consenting to sex at 5am having been asleep unless they say otherwise and find it shocking that people see it otherwise.
I don't disagree re:consent. But if you're going to say it's "shocking," you have to account for the fact that they were talking about the case, while you say you were not. As we started discussing, it is not "shocking" to point out that there can be quite a few confusing aspects of the situation (sleepy, not sleepy, half-asleep, etc), and I think that is what the boys were stressing. Can't make that kind of statement about what he "did" if we don't know. Blah blah.
If I'm going to keep this consistent with my posts of late, I need a few more words....
