The photo shoot was for an issue of Vogue specifically looking at girls in that age range. Polanski said beforehand he was looking for girls aged 13-14 to appear in the photos. Her mother had to consent to the girl appearing in the photos in the first place as well because she was a minor.

The, "But I didn't know she was that young!" defence, although weak in this case (as she was four years under the age of consent, not just a year or two), was not invoked by Polanski at all during the investigation because it was totally implausible.
