Re: There's some seriously twisted logic in this Camilla Send a noteboard - 29/09/2009 12:47:05 PM
I think part of the controversy is that it is not entirely clear whether he did what he confessed to.

Well I mean he plead guilty to unlawful sex with a 13 year old...that's pretty clear to me. I suppose the controversy is that he claims he had a plea bargain in place and that his time in the mental institution was sufficient to meet the terms of his bargain. The thing is a plea bargain is not final until one has actually been sentenced, and he was never sentenced for his crimes.

Yes, but isn't that the point. People plead guilty to things they do not do because they think their situation looks bad and they are worried they will be sentenced to long periods?

Yeah, people do just that, but they do it knowing the risk of pleading guilty to a crime. A heavy majority of the time the judge will go along with a plea bargain, but sometimes it doesn't happen. It's just a risk you take in that situation. Also, I don't see him claiming anywhere that he's actually innocent. I don't know enough about the case to know for sure, but I haven't seen anything where he's claiming innocence.

As I said, I know very little about this case, but from what I gather from the Guardian and NYT he does not say much of anything about it at all.

Also, rules and laws are not the same things.

No, but they do go hand in hand. They aren't always one and the same, but a country's rules tend to be their laws.

Not at all. Rules include morality and manners that aren't always encoded in laws. Not playing by the rules (rules, not laws) will make people consider you a suspect person and make them more liable to think you will break laws.

I agree they don't always mean the same thing, but in the context of Polanski and his situation when they say rules in the article it seems to me that it's a nice way of saying laws. If I wanted to say yes we admit he broke laws, but be nice about it I would choose the word "rules" instead of laws.

I suspect the "vengeful" comes from not having arrested him before, but grabbing him just as he is about to be honoured?

It took another European country to agree to actually nab him and subsequently extradite him. The way the arrest sounded to me (and I could easily be wrong about this), was that he was nabbed at the airport. Which to me sounds like he was flagged coming into the country and detained because there was an active warrant for his arrest out there. It is however very possible, and I'll even say likely, that the U.S. knew that he was going to attend the ceremony and requested that the authorities there arrest him when he arrived.

Did you read the piece at all? He has a house in Switzerland. He could have been arrested at pretty much any time.

And like I said, it took someone else to agree to actually arrest him. If the government in Switzerland wouldn't agree to arrest him up until recently then the American government couldn't just have someone go to his house there and pick him up. I don't know how often he's been in Switzerland since the international warrant was issued a couple years ago, but I suspect that this is the first time that the government has known well in advance that he was going to be somewhere and actually gotten anyone to agree to arrest him.

Mayhap.

Again, there is a difference between a cult of celebrity and a cult of artistry.

I think they go hand in hand. People aren't going to think twice about some guy that paints bowls of fruit in his basement and sells them at a market being arrested for some crime, but they're sure as hell going to care if some well known artist is arrested.

*cough*Reality television*cough*

*cough*sports*cough*

Cult of Celebrity and Cult of Artistry aren't that different though. Cult of Artistry is simply the name applied to a smaller segment of celebrities...either way you still have to be famous for it to apply. That said, if the treatment of people such as athletes and rich business people in France is significantly different than that of artists, then yes, Cult of Artistry would be a better way of putting it.

Well, the point of the Guardian piece (or, I should say, the point of the introductory section of the Guardian piece) was very much regarding artistry (Genet wasn't so much well known as highly respected by the experts).
