Directly? As in, someone has to say "We will now attack any counterprotesters"? If that is indeed the standard, it is troubling.
In this instance, the violence appears to have been secondary to most of the speech. I'm sure there were instances of hate speech, but over-all, it is legal in the US for a Nazi to say that Jews should be forced to leave the country.
As I understand it, the test has to do with having "fighting words" correct? I may be wrong, but wasn't that the basis on which they broke up the rally after the Unite the Right crowd surrounded the counterprotesters and started using pepper spray and tossing tiki torches at them?
