Tracking underage magic is one discrepancy that bothers me in this series. I usually let things go, but in the next book with Tom Riddle and Marvolo Gaunt Dumbledore says that the Ministry merely know where the magic is taking place, not who is doing it. So Harry could get nailed when Dobby dropped the dessert because no one but Harry lives there who can do magic. Dumbledore further states that it is up to witch and wizard parents to regulate the magic their kids use. I had a huge WTF moment. You know Draco's parents let him do whatever he damn well pleases. If you have a rule this big you should take better steps to enforce it IMHO.

And it's even broader than just that. Remember how in the first book the Ministry - or possibly Dumbledore - seemed to know perfectly at every moment where Harry was, sending letters to "the cupboard on the stairs" and so on. And they can send letters virtually instantaneously, it seems, judging by the "our letter of approximately 22 minutes ago" that is mentioned in the second letter he gets here. Those are both things that don't seem to fit with what we know about the Ministry's abilities and about how wizard mail works.
