This idea of your's that consent is implied is utter nonsense - if you go to sleep is is pretty obvious that it is over.

It is not rape if someone who had sex a few hours ago can, but does not, say, "no," to more. If asleep during sex she could say nothing, so that would be rape.

If someone performed them on me and I never told them to stop I would not blame them for my "refused refusal." We are not talking about a random sex act out of the blue, but someone who (supposedly) already agreed to sex withdrawing consent. Once consent is formally given expecting it be formally withdrawn is reasonable.

No. Obviously a person must be awake before sex, as such, or it is rape, regardless of previous events. If, however, they are awake and previously consented, it is not rape unless they withdraw that consent. I was not there and doubt you were, so all we can take for granted is what those who were agree happened. If that includes sex while she was still asleep, Assange is lucky he did not end up like John Wayne Bobbit. Otherwise, presumption of innocence includes rape accusations.
