If this guy was using sick time, say for authorized paternity leave, there wouldn't be an issue...especially if the FMLA is involved. The difference is that this guy was at work, not off on leave. I don't think that it's unreasonable for the employer to expect the employee to perform competently if they are at work.
It still sucks to cover the work of others, even if they're off on authorized leave. That just makes it suck even more when you are then having to also cover for an employee that is supposed to be there!
